CRIMINAL OFFENSES

When someone is charged with a crime you should always start by considering the seriousness of the charge. Depending on the type of offense the charge seriousness and possible penalty will vary.

 

In the state of California there are three kinds of offenses:

  1. Infractions

  2. Misdemeanors

  3. Felony

INFRACTIONS

An infraction is a type of offense in the California criminal justice system. While Infractions are still regarded as a law violation, they are not deemed to be crimes.

 

Consequently, courts cannot enforce jail time for an infraction. Common examples of California infractions include but are not limited to the following examples:

  • Disturbing the peace

  • Driving without wearing a seatbelt

  • Littering

  • Speeding

 

It's important to remember that infractions are punishable by fines, driving record points but no jail time, or probation.

MISDEMEANORS

 After infractions are misdemeanors. A misdemeanor is more serious than an infraction. One of the characteristics that distinguish a misdemeanor from an infraction is the time associated with the crime.

 

A misdemeanor is an offense where the maximum sentence is no longer than one year in county jail. Remember that a misdemeanor is more severe than an infraction but less severe than a felony.

 

Common examples of California misdemeanors are some of but not limited to the following crimes:

 

  • Disorderly Conduct

  • Petty Theft

  • Simple Assault

  • Shoplifting

 The important thing to remember here is that misdemeanors are punishable by fines probation, and up to one year in county jail.

FELONIES

Last but not least is a felony crime. In California, a felony is specified as a crime that has a maximum sentence of more than one year in incarceration.

 

People convicted of a felony may also be penalized up to $10,000 fines in addition to, or instead of, incarceration.

 

On the other hand, a judge might punish a felony offender to formal probation. Common examples of California felony crimes include but are not limited to the following crimes:

 

  • Assault with a Firearm

  • Attempted Murder

  • Grand Theft

  • Kidnapping

The important thing to remember here is that felonies are punishable by fines, formal probation, over one year in state prison.
